1. Terms and Conditions:
This Terms and Conditions section, together with your Order Confirmation,
will be the Purchase Agreement between Joanet Gallery and yourself,
which will be formalised upon supply of the original Work of Art painted/drawn
by the artist Joanet, who may have signed the work with one of two signatures:
“Joanet” or “Puig”. The work to which your order
refers may bear either of these two signatures, depending on the period
when it was painted/drawn.
No other terms or conditions will be applicable. The Agreement cannot
be amended, unless both parties agree to amend it in writing, by letter
or by e-mail.
2. Placing your Purchase
Order
2.1 In order to place a Purchase Order, you must be aged over 18 and
Joanet Gallery must be able to contact you on a fixed telephone.
2.2 Furthermore, you must also previously register on the registration
page of the web joanet.com. Thus, we have the data necessary to contact
you and will subsequently be able to send you your Purchase.
2.3 You may choose between two alternatives in order to make your purchase
of drawings or paintings:
2.3.1 The first, using the PayPal service that you will find on the
page linked to the joanet.com site. Once you have chosen your work and
wish to place a Purchase Order for it, you will automatically access
the secure PayPal page, where, following the instructions thereon, you
must enter the details of your credit card in order to pay for the work
chosen. Once your Purchase Order has been issued, you will receive a
notification stating that payment has been made and will receive an
invoice for it.
2.3.2 The second alternative for purchasing is to telephone us directly
on 0034 934 194 960, from Monday to Friday, from 9.30 to 18.00 (Spanish
local time).
Purchase Orders sent by any means other than those described above will
not be accepted.
2.4 After your Purchase Order has been placed, we will send you an Order
Number. This will be notified to you by e-mail unless you have placed
your order directly by telephone, in which case we will inform you of
said number by telephone. Sending your order number does not place the
Joanet Gallery under the obligation to accept your purchase offer.
2.5 By placing your Purchase Order, you are confirming an offer for
the purchase of an original painting or drawing by the professional
artist Joanet. The Purchase Order that you have placed from among the
works exhibited in the web gallery may by accepted or otherwise, at
the discretion of the artist Joanet, who may ultimately refuse your
offer and refund your money.2.6 Joanet Gallery site will make every
effort possible to meet your Purchase Order. In the event that, for
any reason, it were not possible to supply the work chosen by you, given
that the works are unique and exclusive, Joanet Gallery will offer you
another work of similar characteristics. If you do not accept the proposed
purchase alternative, your Purchase Order will be cancelled and, if
applicable, any sum/s settled up to that date for the cancelled purchase
will be refunded.
The responsibility of Joanet Gallery in relation to your Purchase Order
is limited to refunding the aforementioned amounts.
3. Supply of the pictorial work of art ordered
Joanet Gallery will supply the pictorial work stated in the Confirmation
of your Purchase Order to you, pursuant to the present Terms and Conditions.4.
Prices
4.1 The prices of each one of the paintings or drawings are stated next
to each one of the photographs of the works on the pertinent page of
Joanet Gallery. The price is stated in Euros, with the name of the work
and the year in which it was painted/drawn. Said price will be shown
on the final invoice.
4.2 If the work of art purchased is sent and invoiced to an address
within Spanish territory, Value-Added Tax (V.A.T.) will be applied to
the price of the work(s), pursuant to Spanish tax legislation. If the
work purchased is sent and invoiced to an address outside Spanish territory,
said tax will not be applied.
4.3 Sending expenses will be payable by the Purchaser and will be included
on the invoice sent to you.
5. Forms of payment
5.1 The Joanet web page gives details of the payment systems accepted.
5.2 Payment will be made in the currency stated on the Invoice.
5.3 If you wish to pay by credit card, you must provide your card details
when placing your Purchase Order, through the Pay-Pal service. When
Joanet Gallery issues the invoice, the charge will be made to your account.
The work of art will not be sent until the card-issuing entity has authorised
the charge. If authorisation of the charge is not received, we will
contact you to solve the problem.
5.4 If you wish to pay by cheque, transfer or money order, you will
be sent a payment request. Once the amount of the purchase has been
received, the work will be sent to you. If, after thirty days have elapsed
as from the payment request, the full amount has not been received,
your Purchase Order will be cancelled.
5.5 The documentation relating to the purchase (charge request, invoice
and Certificate of Authenticity of the work) will be sent to the e-mail
address that you provide on your Order Form. Notwithstanding, if you
thus request, we will send the documentation to any address you provide
to us.
6. Delivery of the
work of art
6.1 We will send your original painting, appropriately packed, to the
delivery address that appears on your Purchase Order Form.
6.2 We will try to send your work within the 12 days following your
receipt of our Purchase Order Confirmation. The fact that you have requested
several works at the same time does not oblige us to deliver all the
works at the same time and they may be delivered on different dates.
You may cancel your Purchase Order at any time before actual delivery
of the pictorial work requested by phoning us on 0034 934 194 960, quoting
your Web Order Number.
6.3 Upon delivery of the work, ownership thereof and the risk of loss
are transferred, Joanet Gallery and the artist becoming exempt from
all responsibility therefor.
6.4. If you have provided us with an e-mail address on the Purchase
Order Form, we will send you confirmation of the dispatch by e-mail
at the moment the work of art is placed at our transport company’s
disposal.
7. Right to Return
the Work Acquired
7.1 If you are not satisfied with the work of art acquired, you may
return it and have the price thereof refunded if, within a term of 14
days as from receipt of the work, you contact Joanet Gallery and the
painting is in perfect condition, with no flaws or tears.
7.2 In order to return the work of art, you must telephone us on the
number 0034 934 194 960 from Monday to Friday from 9.30 to 18.00 (Spanish
local time) in order to arrange the return. The work must be in the
original packaging and in perfect condition. You must keep a signed
copy of the delivery documentation that the transport company provides
to you upon collection.
7.3 Once Joanet Gallery has received the work and it has been checked
to be in good condition, the amount paid for the painting will be refunded
to you.
8. Our Responsibility
8.1 Since the objects are unique and exclusive works of art painted/drawn
by the artist Joanet, there are no warranties, conditions or other terms
binding on the Joanet Gallery apart from those expressly stated in the
Purchase Order Agreement.
8.2 Any warranties, conditions or terms relating to the pictorial works
that could otherwise be deemed to be implied in or incorporated into
the Agreement by statute, common law or in any other way are expressly
excluded from this Agreement. Likewise, any implied term as to quality,
fitness for purpose, reasonable care and skill is excluded. In particular,
Joanet will not be responsible for guaranteeing that the pictorial works
of art are suitable for your purpose.
9. Force Majeure
Joanet Gallery is obliged to meet the obligations derived from the Purchase
Order Agreement. However, it accepts no responsibility for delays due
to force majeure or third-party breaches. In the event of a delay in
meeting the obligations, they will be performed as soon as is reasonably
possible.
10. Applicable Law
and Jurisdiction
It will be attempted to solve any discrepancy swiftly and efficiently,
although, if it is not solved on a friendly basis, the Purchaser expressly
submits himself to Spanish law and any litigation must be filed in Spain.
11. General
11.1 Failure to require compliance with any of the conditions included
in this Agreement, on either your part or ours, does not constitute
a waiver of said condition and the affected party may require compliance
therewith subsequently.
11.2 The invalidity or ineffectiveness of any of the clauses of this
Agreement shall not affect the overall validity hereof, it being compulsory
to comply with the remaining clauses.
12. Definition of Terms
12.1 In the present Terms and Conditions:
“Pictorial work of art” is any painting or drawing, in oils,
acrylic or gouache, on canvas, paper or cardboard, by the abstract painter
Joanet.
“Joanet”: pseudonym or alias used by the artist Juan Puig
to sign his pictorial work.
“Your Purchase Order Confirmation” refers to the order confirmation
issued by Joanet Gallery stating acceptance of your Purchase Order.
“Agreement” refers to these Terms and Conditions together
with your Purchase Order Confirmation.
“Working Day” is any day other than Saturday, Sunday or
a public holiday in Spain.
“Invoice” is the document that Joanet Gallery will issue
to you with the price of the pictorial work, taxes and transport expenses.
“Export Laws” includes all the laws, provisions and decrees
of the United States, the European Union and Spain applicable to exportation,
re-exportation, transfer or resale of Products.
“Purchase Order” means a purchase order placed by you pursuant
to these Terms and Conditions.
1. Acerca de los Términos y Condiciones:
En el presente apartado de "términos y condiciones"
cuando se emplea la palabra "nosotros" y/o "nos"
hace referencia directa a "Joanet Gallery", y cuando se habla
de "Ud." nos referimos a "usted", el cliente.
Este apartado de términos y condiciones, junto con su Confirmación
de Pedido, constituirá el Contrato de Compraventa entre Joanet
Gallery y Ud., que se formalizará en el momento en que se suministre
la Obra, sea esta Pictórica o Dibujo.
No serán de aplicación ningunos otros términos
o condiciones. El Contrato no podrá ser modificado, salvo que,
ya sea por escrito, a través de carta o correo electrónico,
ambas partes accedan a modificarlo.
2. Realización
de Su Pedido-Compra
2.1 Es preciso para realizar un Pedido-Compra tener más de 18 años
de edad y que Joanet Gallery pueda acceder a Ud. mediante teléfono
fijo.
2.1.1 Puede Ud. escoger entre dos opciones para realizar su compra de
dibujos o pinturas:
2.1.2 La primera, registrarse en la web joanet.com y a continuación
rellenando el Formulario de Compra, que encontrará en la Página
Link de PayPal de Joanet.com, una vez haya accedido a la misma o creado
su propia cuenta, haciendo click en el botón "Emitir mi Pedido-Compra";
2.1.3 La segunda, llamándonos por teléfono al 0034 934 194
960, de lunes a viernes, de 9:30 a 18:00 horas (hora local de España).
No se aceptarán Pedidos-Compra enviados de forma distinta a las
indicadas anteriormente.
2.3 Tras realizar su Pedido-Compra, le enviaremos una confirmación
y un Número de Pedido. Esta notificación se hará
a través del Web de Joanet, excepto en el caso de que Ud haya realizado
su Pedido-Compra por teléfono, en cuyo caso le comunicaremos dicho
número telefónicamente. El envio de su número de
pedido no obliga a la Joanet Gallery a aceptar su oferta de compra.
2.4 Con la realización de su Pedido-Compra, Ud. nos hace una oferta
de compra de una obra pictórica o un dibujo original realizados
por el artista profesional Joanet. Éste ha firmado sus obras bajo
dos rúbricas: "Joanet" y "Puig". La obra objeto
de su pedido puede llevar una de las dos firmas, dependiendo de la época
en la que haya sido realizada.
El Pedido-Compra que Ud. ha seleccionado, de entre las obras expuestas
en la galería de la web, podrá ser aceptado o no, a discreción
del Autor o de Joanet Gallery, quienes pueden rechazar su oferta.
2.5 De aceptarse su Pedido-Compra, le notificaremos la misma emitiendo
una Confirmación de Pedido. La Confirmación de Pedido le
será emitida, bien por correo electrónico, siempre que Ud.
nos lo haya facilitado en su Formulario de Pedido, o por correo postal;
siendo efectiva desde su envío. Si no pudiera aceptarse su Pedido,
se intentará contactar con Ud., a través de cualquier medio
de comunicación.
2.6 Joanet Gallery realizará todos los esfuerzos posibles para
cumplimentar su Pedido-Compra. En el supuesto de que, por cualquier causa,
no fuera posible suministrarle la obra escogida por Ud., dado que se trata
de obras únicas y exclusivas, Joanet Gallery le ofrecerá
otra obra, de características similares. Sí Ud. no aceptara
la alternativa de compra propuesta, se procederá a cancelar su
Pedido-Compra, y se le devolverá en su caso la/s suma/s satisfechas
hasta la fecha por la compra cancelada.
La responsabilidad de Joanet Gallery respecto a su Pedido-Compra se circunscribe
a la devolución de las cantidades reseñadas.
3. Suministro de la obra de arte pictórica solicitada
Joanet Gallery le suministrara la obra pictórica indicada en la
Confirmación de su Pedido-Compra, conforme a los presentes Términos
y Condiciones.
4.Precios.
4.1 El precio de la/s obra/s de arte constarán reseñados
en la web Joanet Gallery, y se reflejará en la Factura final.
4.2 Si usted es español, al precio de la/s obra/s se aplicará,
si corresponde de acuerdo con la normativa fiscal española, el
Impuesto sobre el Valor Añadido (I.V.A.), que será abonado
por el Comprador.
Si usted es un comprador residente fuera del territorio español,
no se le aplicará dicho impuesto.
4.3 Los gastos de envío serán de cargo del Comprador, y
quedarán incluidos en la Factura que se le remitirá.
5. Formas
de pago:
5.1 La página web de Joanet detalla los sistemas de pago aceptado.
5.2 El pago se efectuará en la moneda indicada en la Factura.
5.3 Si desea pagar con tarjeta de crédito, Ud. deberá proporcionar
los datos de su tarjeta en el momento de realizar su Pedido-Compra, mediante
el sistema de cobro realizado por Pay-Pal. Al emitir Joanet Gallery la
Factura se procederá a realizar el cargo en su cuenta. No se procedera
al envío de la obra de arte hasta que la entidad emisora de su
tarjeta de crédito no haya autorizado el cargo. De no recibir la
autorización del cargo nos pondremos en contacto con Ud. para solventar
el inconveniente.
5.4 La documentación relativa a la compra (petición de cargo,
factura y Certificado de autenticidad de la obra) será enviada
a la dirección de correo electrónico que nos facilite en
su registro y en su Formulario de Pedido, no obstante, sí así
nos lo solicita, le remitiremos la documentación a la dirección
que Ud. nos facilite.
6. Entrega
de la obra de arte.
6.1 Le enviaremos su pintura original o dibujo original, convenientemente
empaquetadosa la dirección de entrega que figure en su Formulario
de Pedido-Compra.
6.2 Procuraremos enviarle su obra dentro de los 12 días siguientes
a la recepción de su Confirmación de Pedido-Compra. El hecho
de que Ud. haya solicitado varias obras a la vez, no nos obliga a que
la entrega de todas las obras se haga en el mismo momento, éstas
pueden ser entregadas en distintas fechas.
Ud. podrá cancelar su Pedido-Compra en cualquier momento antes
de la entrega efectiva de la obra pictórica solicitada llamándonos
al 0034 934 194 960 mencionando su Número de Pedido Web.
6.3 Con la entrega de la obra se trasmite la titularidad de la misma y
el riesgo de pérdida, quedando exenta de toda responsabilidad Joanet
Gallery y e l autor sobre la misma.
6.4 Sí Ud. nos ha indicado una dirección de correo electrónico
en el Formulario de Pedido-Compra, en el momento en que la obra de arte
se ponga a disposición de nuestro transportista, le enviaremos
confirmación del envío por correo electrónico.
7. Derecho
de Devolución de la Obra adquirida
7.1 Si no está Ud. satisfecho con la obra de arte adquirida, podrá
devolverla y obtener el reembolso del precio de la misma, sí dentro
del plazo de 14 días desde la recepción de la obra, se pone
en contacto con Joanet Gallery, y la pintura se halla en perfecto estado
de conservación, sin desperfectos ni roturas.
7.2 A efectos de proceder a la devolución de la obra de arte, deberá
telefonearnos al número 0034 934 194 960 de lunes a viernes de
9:30 a 18:00 horas (Horario local de España), para concertar la
devolución. La obra deberá ir dentro del embalaje original
y hallarse en perfecto estado de conservación. Deberá Ud.
conservar una copia firmada de la documentación de entrega que
le facilite el transportista en el momento de la recogida.
7.3 Una vez la obra esté en poder de Joanet Gallery y se compruebe
su buen estado de conservación, se procederá a reintegrarle
el importe abonado por la pintura.
8. Nuestra Responsabilidad
8.1 Tratándose de obras de arte, piezas únicas y exclusivas,
realizadas por el artista Joanet, no existen garantías, condiciones
u otros términos vinculantes para Joanet Gallery salvo lo expresamente
manifestado en el Contrato de Pedido-Compra.
8.2 Quedan expresamente excluidos del presente contrato, cualesquier garantía,
condición o término relativo a las obras pictóricas
que pudieran de otro modo darse a entender o incorporarse en el Contrato
por derecho dispositivo, derecho consuetudinario, o de cualquier otra
forma, asimismo, se excluye, cualesquier término implícito
de calidad o de idoneidad para un fin determinado, cuidado y pericia razonables).
En especial, Joanet no será responsable de garantizar que las obras
de arte pictóricas sean adecuados a sus fines.
9. Fuerza Mayor.
Joanet Gallery se
obliga a cumplir con las obligaciones derivadas del Contrato Pedido-Compra.
Sin embargo, no se hace responsable por demoras debidas a causas de fuerza
mayor, o incumplimiento de terceros. De producirse un retraso en el cumplimiento
de las obligaciones, éstas se harán efectivas tan pronto
como sea razonablemente posible.
10. Ley
Aplicable y Jurisdicción.
Se intentará resolver cualquier discrepancia rápida y eficientemente,
si bien no llegase a solventarse la misma amigablemente, el Comprador
se somete expresamente a la ley española, siendo necesario interponer
en España cualquier controversia judicial.
11. General
11.1 La no exigencia de cumplimiento de alguno de los términos
incluidos en este Contrato, ya sea por su parte o por la nuestra, no constituye
renuncia a dicho término. Pudiendo la parte afectada exigir su
cumplimiento con posterioridad.
11.2 La invalidez o ineficacia de alguna de las cláusula del Contrato
no afectará a la validez de su conjunto, siendo de obligado cumplimiento
las restantes cláusulas.
12. Definición
de Términos
12.1 En los presentes términos y condiciones:
"obra de arte " es toda pintura o dibujo sea esta al óleo,
acrílica o gouache realizada sobre tela, papel o cartón,
realizada por el pintor abstracto Joanet.
"Joanet" Seudónimo o alias utilizado por el artista Juan
Puig para la firma de su obra pictórica.
"Confirmación de su Pedido-Compra" se refiere a la confirmación
de pedido que emitie Joanet Gallery indicando la aceptación de
su Pedido-Compra.
"Contrato" se refiere a estos términos y condiciones,
junto con su Confirmación de Pedido-Compra;
"Día Laborable" es cualquier día distinto de sábado,
domingo o día festivo en España;
"Factura" es el documento que Joanet Gallery le emitirá
con el precio de la obra pictórica, impuestos, más los gastos
de envío
"Formulario de Pedido" es el formulario electrónico de
pedido de la Página Web de la Joanet.com, con el cual Ud. puede
formalizar su Pedido-Compra;
"Leyes de Exportación" contempla todas las leyes, disposiciones
y decretos de los Estados Unidos, la Unión Europea y España,
aplicables a la exportación, re-exportación, traspaso o
reventa de Productos;
"Número de Pedido Web" es el número de pedido
que Joanet Gallery le remite al recibir su Pedido.
"Pedido-Compra" significa un pedido-compra realizado por Ud.
de conformidad con estos términos y condiciones.
